We evaluate the issues affecting each client instead of assuming every matter should follow the same course.
Family Court Jurisdiction for Schertz Cases
Schertz extends across Bexar, Guadalupe, and Comal Counties, so the correct filing location depends on the facts of the case. Jurisdiction refers to a court’s legal authority to hear and decide a matter. Texas district courts have original jurisdiction over divorce and other family law proceedings, but residence and existing orders can affect where a case belongs.
On the Guadalupe County side of Schertz, the 25th Judicial District Court and the 2nd 25th Judicial District Court hear family matters, including divorce, custody, support, paternity, and protective orders. Our attorneys also know the Bexar County family courts serving the portion of Schertz within the county that includes San Antonio. We assess jurisdiction before advising where a new case may be filed or a prior order addressed.
Texas Divorce Requirements & Expected Timing
An initial family law consultation allows a prospective client to explain the circumstances, identify immediate priorities, and discuss the legal issues requiring attention. It can also distinguish urgent concerns from issues that may be addressed as the case develops. The appropriate path depends on the facts, disputed questions, and orders the court may need to enter.
Divorce Residency Requirements
Texas Family Code Section 6.301 establishes the residency requirements for filing a divorce suit. When the case is filed, either spouse must have been domiciled in Texas for the preceding six months and a resident of the filing county for the preceding 90 days. Domicile generally means that Texas is the person’s permanent home, while county residence concerns where that spouse lived during the required period.
These rules determine whether a Texas court can hear the divorce and which county may be appropriate. They don’t mean that every Schertz divorce belongs in the same court, particularly because the city crosses county lines.
The 60-Day Divorce Waiting Period
Under Texas Family Code Section 6.702(a), a court generally can’t grant a divorce before the 60th day after the suit is filed. This is a minimum statutory waiting period, not a prediction of how long the case will take. Disputes involving children, support, property, or other orders can extend the process.
The waiting period doesn’t apply when a court makes the family-violence finding described in Texas Family Code Section 6.702(c). Determining whether that exception or another legal consideration applies requires an assessment of the specific circumstances.
Legal Strategies Shaped Around Your Priorities
We develop family law solutions tailored to each client’s needs. Before recommending an approach, we seek to understand the family dynamics, disputed facts, immediate concerns, and longer-term priorities that may shape important decisions.
Direct communication is central to that process. We explain potential costs, expected outcomes, and the legal implications of available options so clients can make informed choices. Although outcomes can’t be guaranteed, a careful assessment can clarify the strengths, risks, and practical consequences of each path.
A personalized strategy may involve negotiation, an agreed resolution, court proceedings, or a combination of approaches as the case develops. The direction depends on the client’s objectives, the response of the other parties, and the evidence and orders at issue.
